TERMS & CONDITIONS – STUDIO
By participating in our courses and/or offerings, you are a “Participant”. The Participant willingly decides to adhere to the terms and conditions set forth on this page. Members are a limited subset of Participants, granted monthly access to the studio.
1. Payment
1.1 Fee: The Participant agrees to pay a fee incl. VAT before the class takes place.1.2. Club Clay and Monthly Membership: For rare instances of monthly membership, including the use of the Studio space, shared equipment, firing volume as stated, and limited storage are part of the membership package. If the Member has limited items in storage, for advance arrangements of full month of non-use of the Studio, the Studio may grant, at its discretion and approval, a discount for one month. A discount would only be available every 12 months rolling.
1.3 Payment Terms: The fee is due on the 1st day of each month. Late payments may incur a penalty of 10% extra rent after a grace period of 15 days.
1.4 Cancellation: The Participant may cancel their class by providing 7 days in advance written notice to the Studio. Members must provide 1 full calendar month notice of any cancellation in writing to the Studio. No refunds will be issued for unused days in Club Clay or monthly membership once commenced.2. Insurance
2.1 Personal Insurance: The Participant is required to maintain their own personal liability insurance, covering any injuries, accidents, or damages that may occur during the use of the Studio’s facilities or equipment.
2.2 Proof of Insurance: The Participant agrees to provide the Studio with proof of valid insurance coverage upon request.3. Guidelines for Use of the Space
3.1 Studio Access: The Participant is granted access to the Studio during the designated hours, unless otherwise specified by the Studio. Members may access the Studio at their leisure unless notified that there is limited space availability for classes or club activities. These activities will be posted to the Members a month in advance of planned activities.
3.2 Equipment Use: The Participant agrees to use all Studio equipment and materials in a safe and responsible manner, following the instructions provided by the Studio.
3.3 Respect for Others: The Participant agrees to respect the Studio and other Participants by maintaining a friendly and cooperative atmosphere, refraining from disruptive behavior, and being mindful of noise levels.
3.4 Studio Hours & Availability: The Studio may, at its discretion, close for maintenance, workshops, or other events. The Participant will be notified in advance of any extended closures.4. Cleaning and Maintenance
4.1 Cleaning Responsibility: The Participant agrees to clean up after themselves and to leave the Studio and equipment in the same condition they found them. The Participant agrees to help cleaning in the last 30 minutes of their studio time.
4.2 Shared Space: The Participant will take responsibility for maintaining cleanliness in the shared areas, including countertops, sinks, and common tools. The Participant will also take efforts to avoid using the pantry sink for cleaning or non-food related disposal. Limited clay or glaze cleaning is expected for the bathroom sink (i.e., mostly clean items and hands can be washed).
4.3 Cleaning Supplies: The Studio will provide cleaning supplies, but the Participant is responsible for cleaning their workspace after each session.
4.4 Failure to Clean: If a Participant fails to clean their workspace, the Studio reserves the right to charge a cleaning fee of 25 euro to the Participant.5. Raw Materials and Supplies
5.1 Raw Materials: The Member is responsible for purchasing their own raw materials (e.g., clay, tools). The Studio shares basic tools and may offer materials for sale at an additional cost, subject to availability. Details of any materials brought from the Participant’s own purchases, such as glaze, clay, and porcelain must be shared with the studio (via SMS message, email, or WhatsApp) to ensure that firing is done correctly. Any damages from firing without sharing details with the Studio will be at the cost of the Participant (e.g., kiln damage, kiln shelf, or kiln post damage). Members must also make their own cookies or prevention of dripping of glazes.
5.2 Material Storage: The Member may store their raw materials and completed work in designated areas. The Studio is not responsible for any lost, stolen, or damaged materials.
5.3 Bulk Orders: The Studio may offer to facilitate bulk orders of materials for Members at a discounted rate, subject to availability and a minimum order quantity. All orders are subject to required taxation for the locality the Studio and Member is located in.
6. Cancellation & Transfer Policy Courses & Workshops
6.1 Advance preparation is a built in activity for classes, workshops, and events; this includes but is not limited to scheduling external teachers and preparing materials and agenda in advance. Cancellation or changing your ticket data implies extra work from our side and costs. Your cancelled workshop seat might not be filled on time with an alternative candidate.
6.2 Cancellation & Transfer Policy Courses & Workshops
- Cancellations more than 7 days before the course starts: Full refund.
- Cancellations within 72 hours before the course start date: 50% refund.
- Cancellations in less than 72 hours before the course start date are not refundable.
7. Termination of Membership
7.1 Violation of Terms: A harmonious and cohesive environment is essential to the Studio. The Studio reserves the right to terminate the Participant’s membership or course if they violate any of the terms outlined in this Agreement, including but not limited to failure to pay fees on time, misuse of space or equipment, failure to maintain insurance, or disruptive behavior.
7.2 No Refunds: In the event of termination, no refunds will be issued for the remaining portion of the membership term.
8. Liability and Indemnity
8.1 Liability: The Studio is not responsible for any loss, damage, or injury to the Participant, their belongings, or any third parties while using the Studio facilities.
8.2 Damages: The Studio cannot not provide guarantee on the outcomes of firing. When handling the ceramic items, the Studio does its best to both instruct Participants of limitations of clay/glaze, however, due to the properties of ceramic and glazes, damages (cracks, warping, breakage, bubbling/crawl) may be incurred during the handling and firing processes. Participants will be notified if any issues arise during the course of their participation, the Studio at its knowledge and discretion may offer a solution. Participants that do not adhere to Studio’s requirements, particularly during the glazing process, may need to pay for damaged kiln equipment and/or repairs. Participants bringing in outside clay and glaze materials must share information with the Studio on their properties. Damages to kiln or kiln equipment/furniture may be required by the Studio for any misrepresentation by the Participant.
8.3 Indemnity: The Participant agrees to indemnify and hold harmless the Studio, its owners, employees, and agents from any claims, liabilities, or damages arising from the Participant’s use of the Studio.
9. Miscellaneous
9.1 Changes to the Agreement: The Studio reserves the right to modify this Agreement at any time. Any changes will be communicated to the Participant in writing, and the Participant will have the option to accept or terminate their membership.
9.2 Governing Law: This Agreement shall be governed by the laws of the Netherlands.
By agreeing to this information, the Participant acknowledges that they have read, understood, and agree to the terms of this Membership Agreement.
